1.3. Use of the Platform constitutes full acceptance of these Terms.

- Advertiser — a company with an advertiser account on the Platform, listed in the Company Directory.
- Lead — contact data voluntarily submitted by a User to an Advertiser via the contact form.
- Company Directory — the Platform section containing Advertiser profiles.
- Price data — hourly wholesale electricity prices from the ENTSO-E Transparency Platform.
§3. Conditions of use
3.1. The Platform may be used by natural persons, legal entities and unincorporated organisations.
3.2. Use of the Platform is free of charge for individual Users with respect to browsing data, the Company Directory and alert management.
3.3. The Platform is available 24/7, subject to possible technical maintenance.
§4. Registration and account
4.1. Registration requires an email address, password and acceptance of the Terms and Privacy Policy.
4.2. The User is responsible for the security of their login credentials.
4.3. One account per email address.
4.4. The Operator reserves the right to suspend or delete accounts that violate these Terms without prior notice.
§5. Platform functionality
The Platform provides, among other things:
- Hourly wholesale electricity prices for 26 EU countries;
- Price history from 2015;
- Push and email alerts when prices drop below a chosen threshold;
- Currency converter (9 currencies);
- Company Directory (renewable installers, battery storage providers, energy advisors);
- Price statistics and charts.
§6. Source of price data
6.1. Price data is sourced from the ENTSO-E Transparency Platform and collected automatically.
6.2. The Operator does not guarantee the completeness, accuracy or real-time availability of data. Data is for informational purposes only and does not constitute investment advice.
6.3. The Operator is not liable for decisions made on the basis of Platform data.
6.4. ENTSO-E is the sole official source of price data displayed on the Platform. ENTSO-E is not party to any agreement with the User and bears no liability for the Platform's operation.
§7. Company Directory — user rules
7.1. The Company Directory contains profiles of Advertisers — energy sector companies.
7.2. Presence in the Directory is a paid service for Advertisers and does not constitute a recommendation by the Operator.
7.3. The Operator is not liable for the content of offers, quality of services or contracts between Users and Advertisers.
§8. Advertisers — participation conditions
8.1. Advertiser status is available to legally operating energy sector companies after signing a separate commercial agreement with the Operator.
8.2. Advertisers commit to providing accurate information about their company, services and contact details.
8.3. The Operator may remove an Advertiser's profile at any time for breach of these Terms or the commercial agreement.
§9. Transfer of user contact data (Lead)
9.1. The Lead form allows Users to voluntarily submit contact data to a chosen Advertiser.
9.2. Before submission, the User sees the list of Advertisers to which their data will be sent and must actively tick a consent checkbox.
9.3. Consent is one-time. Users may request deletion of Lead data from the Operator or directly from the Advertiser.
9.4. The Operator acts solely as an intermediary and is not liable for Advertiser actions after Lead transfer.
§10. Advertiser obligations to users
Advertisers commit to:
- Processing Lead data solely for preparing a quote for the User;
- Not sharing Lead data with third parties without User consent;
- Not adding the User to mailing lists without consent;
- Deleting Lead data on User request;
- Deleting Lead data after 90 days if no commercial contact has been established.
Breach of these obligations may result in removal of the Advertiser account and legal claims by the Operator.
§11. Notifications and alerts
11.1. Price alerts (automatic) are sent to Users who have enabled notifications and set a price threshold.
11.2. The Operator does not guarantee delivery of notifications within any specific time. Notifications are informational only.
11.3. Users may disable notifications at any time in the app settings or profile.
11.4. The Operator distinguishes three types of push notifications sent to the User:
- (a) System notifications — operational messages relating to the Platform itself, in particular: information about new app versions, planned maintenance, changes to the Terms or Privacy Policy, critical security warnings, and price alerts configured individually by the User. These notifications are necessary for the proper use of the Platform and do not require separate marketing consent. They are sent under Art. 6(1)(b) GDPR (performance of the service contract). The User can disable them in the device's system settings or by deleting the account.
- (b) Individual notifications — messages addressed directly to a specific User by the Operator in response to a report, support request, contact form question, or to provide account-related information. They are sent under the legitimate interest of the Operator and the User (Art. 6(1)(f) GDPR) and do not require separate marketing consent.
- (c) Bulk notifications (marketing) — commercial, informational-promotional messages, Advertiser offers, sales-oriented feature announcements, quarterly reports, etc., addressed to a larger group of Users at once. They are sent only to Users who have given separate, voluntary and explicit consent in the app (Profile → Marketing notifications). Consent can be withdrawn at any time in the same place, without affecting the lawfulness of processing prior to withdrawal. The legal basis is Art. 6(1)(a) GDPR and Art. 10 of the Polish Act of 18 July 2002 on the provision of services by electronic means.
11.5. The Operator does not use the push token for any purpose other than sending the notifications described above. The token is not shared with third parties except the push delivery operator (Expo Push Service / Google FCM / Apple APNs) strictly to the extent technically required to deliver the notification.
11.6. The frequency of bulk (marketing) notifications is limited. The Operator commits not to send more than one bulk notification per day to the same User and not to send such notifications between 22:00 – 07:00 of the User's local time.
11.7. Every marketing notification contains, in its body or on the accompanying screen, the identity of the sender ("VoltAlert / Samael Sp. z o.o.") and a link allowing the User to quickly turn off this type of notification.
§12. Fees
12.1. Use of the Platform by individual Users is free of charge.
12.2. Company Directory listing as an Advertiser is subject to fees per the current price list.
12.3. The Operator reserves the right to introduce paid features for Users with 30 days' prior notice.
§13. User obligations
Users commit to:
- Using the Platform in accordance with applicable law and these Terms;
- Not undertaking actions that disrupt the Platform's operation;
- Not automating requests to the Platform (scraping, bots) without the Operator's consent;
- Not using the Platform for unlawful purposes.
§14. Limitation of liability
14.1. The Platform and its data are provided "as is", without warranties of completeness, accuracy or fitness for any particular purpose.
14.2. The Operator is not liable for:
- commercial, investment or other decisions made on the basis of Platform data;
- Platform unavailability due to technical failures, force majeure or third-party actions;
- Advertiser actions towards Users after Lead transfer;
- quality of services provided by Directory Advertisers;
- delays or non-delivery of push notifications.
14.3. The Operator's total liability to any one User is limited to fees paid by that User to the Operator in the preceding 12 months, not exceeding PLN 500 (approximately EUR 115).
§15. Intellectual property and data redistribution
15.1. All intellectual property rights in the Platform (code, design, logo, interface) belong to Samael Sp. z o.o.
15.2. Prohibition on unauthorised use of data: Data presented by the Platform (charts, tables, statistics, prices) is provided for personal, non-commercial use only.
15.3. Any public distribution, retransmission, publication, scraping or commercial use of Platform data is strictly prohibited without prior written consent from the Operator.
15.4. For non-commercial, educational or informational citation of Platform data, the following is required: (a) clear attribution to "VoltAlert (voltalert.pl) / ENTSO-E"; (b) a link to voltalert.pl; (c) prior notification to the Operator at biuro@samael.pl.
15.5. Violation of the above entitles the Operator to claims under Polish copyright law, unfair competition law, GDPR and other applicable legislation.
15.6. Price data originates from ENTSO-E, which also has its own rights and restrictions on further use of data.
§16. Account deletion
Users may delete their account at any time in the app or at voltalert.pl/delete-account.html. The operation is irreversible. Data is permanently deleted in accordance with the Privacy Policy.
§17. Service availability
The Operator strives to ensure continuous Platform availability but does not guarantee the absence of technical interruptions. Planned maintenance will be communicated in advance.
§18. Amendments
The Operator may amend these Terms with 14 days' prior notice. Registered Users will be notified by email. Continued use of the Platform after the effective date of changes constitutes acceptance.
§19. Complaints
Complaints should be submitted to biuro@samael.pl with a description of the issue. The Operator handles complaints within 14 business days.
§20. Governing law and dispute resolution
These Terms are governed by Polish law. The competent court is the court of general jurisdiction for the Operator's registered seat. Consumer Users may use the EU ODR platform: ec.europa.eu/consumers/odr.
§21. App stores (Google Play and App Store)
21.1. By downloading the App from an app store (Google Play or the App Store), the User is additionally subject to that store's terms. In the event of a conflict regarding use of the App, the mandatory requirements of the relevant store prevail.
21.2. Applies to the iOS version. The User and the Operator acknowledge that these Terms are concluded between the User and Samael Sp. z o.o., and not with Apple Inc. ("Apple"). Samael Sp. z o.o. is solely responsible for the App and its content. Apple has no obligation to provide any maintenance or support services for the App.
21.3. If the App fails to conform to any applicable warranty, the User may notify Apple, and Apple may refund the purchase price of the App (the App is free of charge). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. This does not affect consumer rights under mandatory law.
21.4. Apple is not responsible for addressing any claims of the User or any third party relating to the App or its possession and use, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, consumer protection claims, and intellectual property infringement claims. Samael Sp. z o.o. is solely responsible for such claims.
21.5. The User represents and warrants that they are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that they are not listed on any U.S. Government list of prohibited or restricted parties.
21.6. Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to the iOS version and, upon the User's acceptance of these Terms, have the right (and will be deemed to have accepted the right) to enforce these Terms against the User as a third-party beneficiary.
